NAT II Offerors,

The proposal submission date for NAT II was in April 2013. This included utilizing APPF for designated missions, or set aside Mission Units.

On July 4, 2013, the US Government and Afghanistan Government signed a Convoy Service Agreement (CSA) which included a better value for using this service. This allows contractors to give a more competitive price if considering the better value. The problem is that many of the  Offerors were not informed of this change--only some. As they were trying to be awarded a contract, the USG was changing laws and rules for security which affected the price.....and didn't tell the Offerors.

TRANSCOM knew this change took place. TRANSCOM failed to notify Offerors of this change in their preferred security provider. They knowingly continued to evaluate proposals without disclosing change in one of the solicitation requirements and providing an opportunity to adjust pricing accordingly.

To change requirements or feasibility of obtaining a fair and competitive price after proposal submission date and before Award date is unfair and unethical.

TRANSCOM must reissue this solicitation in it's entirety and give all 117 Offerors a fair opportunity of Award. This is completely illegal.
